Dr. David S. Egilman

New York, NY: (Sep-07-07) Eli Lilly brought a lawsuit against Dr. David S. Egilman, alleging that the doctor leaked confidential materials about Lilly's antipsychotic drug Zyprexa. The documents were among evidence provided by Lilly as part of a lawsuit filed by patients who contended that side effects from Zyprexa caused excessive weight gain and diabetes.

In a settlement reached, Egilman, who was an expert witness in a lawsuit against Lilly, will pay $100,000, which the company said it would donate to charity. He acknowledged in a declaration filed in Federal District Court in Brooklyn that he supplied documents to a lawyer in Alaska who sent them to a reporter for the New York Times. Egilman said the documents did not present Lilly's perspective about the drug. Lilly had threatened civil and criminal sanctions against Egilman, but will not pursue them under the settlement. The company has paid more than $1 billion to settle more than 28,000 cases from individuals who contended that they developed diabetes or other diseases from taking Zyprexa. Attorneys general from 30 states have subpoenaed documents detailing Lilly's sales, marketing and promotional practices for Zyprexa as part of a civil investigation under state consumer protection laws.
